2. Definitions

  • "SortedCheck" means our vehicle history check service, available in free and paid tiers.
  • "SortedInspect AI" means our AI-powered vehicle photo inspection and internet research report service.
  • "Marketplace" means our platform for listing and browsing used cars for sale in the UK.
  • "Data Guarantee" means the financial protection included with certain paid SortedCheck tiers, covering losses arising from data inaccuracies up to the stated amount.
  • "Report" means any digital PDF report generated by our services.

3. Our Services

3.1 Free SortedCheck

We provide free vehicle checks using data from the DVLA Vehicle Enquiry Service and DVSA MOT History API. This includes basic vehicle details, tax status, MOT status, MOT history, and ULEZ/Clean Air Zone compliance information. Free checks are advisory only and carry no guarantee.

3.2 Paid SortedCheck

Paid checks provide additional vehicle provenance data sourced from third-party providers including Experian (via OneAutoAPI). This may include stolen vehicle checks, outstanding finance records, insurance write-off history, mileage verification, keeper history, and plate change records. Paid tiers are available at the following price points:

  • Standard £10K (£4.99) — full provenance check with £10,000 data guarantee
  • Protected £20K (£9.99) — full provenance check + salvage records with £20,000 data guarantee
  • Protected £30K (£14.99) — full provenance check + salvage records with £30,000 data guarantee

3.3 SortedInspect AI

Our AI inspection service analyses user-submitted photographs and internet research to provide an advisory condition report. AI analysis may not be 100% accurate. It is advisory only and is not a substitute for a professional mechanical inspection.

3.4 Marketplace

The Marketplace allows users to list and browse used cars for sale. We are not a party to any transaction between buyers and sellers. We do not own, inspect, or take possession of any vehicle listed on the Marketplace.

4. Eligibility

You must be at least 18 years old and resident in the United Kingdom to use our paid services. By using our services, you confirm that you meet these requirements.

5. Account Registration

Certain features require you to create an account using Google OAuth or a magic link sent to your email address. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

6. Prices and Payment

All prices are displayed in pounds sterling (GBP) and include VAT where applicable. Payments are processed securely by Stripe. We do not store your full payment card details on our servers.

We reserve the right to change our prices at any time, but changes will not affect orders already placed and paid for.

7. Data Guarantee

The Data Guarantee applies to Protected tier SortedCheck reports only. It covers financial losses you suffer as a direct result of materially inaccurate data in the report, up to the guarantee amount stated for your tier.

7.1 Conditions

  • The guarantee applies only to the original purchaser of the report.
  • Claims must be submitted within 12 months of the report date.
  • You must provide evidence of the inaccuracy and resulting financial loss.
  • The guarantee does not cover information available from the free tier (DVLA/MOT data).
  • The guarantee does not cover losses arising from information that was accurate at the time of the report but subsequently changed.

7.2 How to Claim

To make a claim, email support@sortedcars.co.uk with your report reference number, details of the inaccuracy, and evidence of your financial loss. We will investigate and respond within 30 days.

8. Your Rights Under the Consumer Rights Act 2015

Our paid services constitute digital content under the Consumer Rights Act 2015. As such, they must be of satisfactory quality, fit for a particular purpose, and as described. If our digital content is faulty, you have the right to a repair or replacement, or a full or partial refund where appropriate.

Nothing in these Terms affects your statutory rights as a consumer.

9. Cancellation and Cooling-Off Period

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a 14-day right to cancel from the date of purchase.

However, because our reports are digital content delivered immediately upon purchase, you will be asked at checkout to:

  1. Expressly consent to immediate delivery of the digital content; and
  2. Acknowledge that you will lose your right to cancel once the report is generated and delivered.

If you have given this consent and acknowledgement, and the report has been delivered, you will not be entitled to a refund under the cooling-off period. See our Refund Policy for full details.

10. Accuracy and Limitations

We source vehicle data from third-party providers including the DVLA, DVSA, and Experian (via OneAutoAPI). While we take reasonable steps to ensure accuracy, we cannot guarantee that all information is complete, accurate, or up to date.

SortedCheck reports and SortedInspect AI reports are advisory only. They should be used as part of your own due diligence when buying a vehicle, and are not a substitute for a professional vehicle inspection.

11. Limitation of Liability

To the extent permitted by law:

  • Our total liability for any claim arising from our services shall not exceed the price you paid for the relevant service, except where a Data Guarantee applies (in which case liability is limited to the guarantee amount).
  • We shall not be liable for any indirect, consequential, or incidental losses.
  • Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

12. Marketplace Terms

The Marketplace is a platform that connects buyers and sellers. We are not a party to any transaction. We do not verify the accuracy of listings, the condition of vehicles, or the identity of sellers beyond the verification checks we perform. You buy or sell at your own risk.

12.1 Seller Verification Fee

To list a vehicle on the Marketplace, sellers pay a one-off verification fee at one of our published tier prices. The fee covers identity and provenance checks performed before the listing is published, including: identity verification through Persona (Government ID, selfie, V5C document); DVLA Vehicle Enquiry Service; DVSA MOT history; and Experian provenance checks (stolen, outstanding finance, insurance write-off, keeper history) supplied through OneAutoAPI. We pay our upstream providers for these checks on a per-vehicle basis, regardless of outcome.

12.2 Listing Review and Information Requests

After you submit a listing, our moderation team reviews it before it goes live. If we need clarification or a fix (e.g. clearer dashboard photo, additional description detail, mileage discrepancy), we will mark the listing "Information requested" in your account. You can respond by editing your listing and submitting a reply through the in-app popup; no other communication channel is required or available.

You have 7 days to respond to each information request. If you do not respond within 7 days, the listing will automatically expire and you will need to start a new one. We will email you when an information request is opened so you don't miss it.

We may open up to 3 information-request rounds on a single listing. After the third round, the listing will be either approved or rejected based on the version we have at that point — no further rounds will be opened.

12.3 Refund Rules for the Verification Fee

Refunds for the verification fee follow these rules:

  • Hard-block — non-refundable. If our checks find the vehicle is recorded as stolen on the Police National Computer, or as a Category A or Category B insurance write-off, the verification has been completed in full and the fee is not refundable. Cat A and Cat B vehicles cannot lawfully be sold or returned to the road, so no listing can be created. We will share the verification result with you on request so you can resolve the underlying issue with DVLA, your insurer, or the police.
  • Persona declined before V5C — 50% refund. If Persona's Government ID or Selfie verification is declined and your V5C document was therefore never checked, we will refund 50% of the fee to your original payment method. The 50% retained covers the Persona inquiry creation cost we have already incurred.
  • Cooling-off cancellation — 100% refund. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a 14-day right to cancel from the date of payment. If you cancel before any verification check has begun (Persona, DVLA, MOT, or OneAutoAPI), we will refund the full fee. To preserve this right you must cancel before opening the verification flow. Once you start verification, you waive this right (see 12.3).
  • Other faults. If a verification fee is charged but no service is performed for any other reason (e.g. our system error), you are entitled to a full refund under the Consumer Rights Act 2015.

12.4 Express Consent at Payment

Before paying the verification fee, you will be asked to actively confirm two things:

  1. That you understand the fee is non-refundable if your vehicle is found to be stolen or a Category A/B write-off.
  2. That you wish verification to begin immediately and that you understand this means you lose your 14-day right to cancel under CCRs 2013 reg. 36 once a check has begun.

Both confirmations are recorded with a timestamp on your verification record. The Pay button is disabled until both are given.

13. Acceptable Use

You agree not to:

  • Use our services for any unlawful purpose.
  • Use automated tools, bots, or scrapers to access our services.
  • Attempt to circumvent rate limits or security measures.
  • Resell or redistribute data obtained from our services.
  • Submit false or misleading information.

14. Intellectual Property

All content on the Website, including text, graphics, logos, software, and reports, is owned by or licensed to Sorted Cars Ltd and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our written permission.

15. Third-Party Services

Our services integrate with third-party providers including the DVLA, DVSA, Experian/OneAutoAPI, Stripe, Google, and Cloudflare. Your use of these third-party services is subject to their respective terms and conditions. We are not responsible for the availability, accuracy, or performance of third-party services.

16. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Continued use of our services after changes are posted constitutes your acceptance of the revised Terms.

17. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you have a complaint that we cannot resolve, you may be able to refer it to an approved Alternative Dispute Resolution (ADR) provider.
